Legal Analysis: 2 Degrees of Freedom
1) Framework of Analysis 2) Arguments This is no new insight, but it does seem that when a judge shifts frameworks of analysis, it has much less of an impact on the relevance of the arguments then s/he tries to make you think it has. It’s one of those things where you’re like, “hey, that sounds about right,” and then after thinking about it for a few minutes you go,...

How To Lie
I used to think that you actually had to say something that sounded true, but it turns out all you need is utter conviction and a seed of doubt in your audience that maybe, just maybe, what you’re saying isn’t untrue.

Disclaimer: I Know Nothing About Economics
Sometimes it’s important to be consistent.  Some people are risk-averse and other people are not.  A lot of people who are risk-averse will occasionally indulge in risk, but the problem with that is that, unlike people who consistently take risks in everything they do, the risk-averse people aren’t at all diversified.  All it takes is one miss to wipe out all of their hard earned gains...

Ok, now I remember what little impact the president has on my day to day life.  I used to pride myself on being able to get through the subway turnstile with one swipe of my Metro Card every time.  Lately I’ve been getting caught up.  Today I had to swipe it like three times.  I’m taking things one day at a time…

Apparently bite size oranges exist.  Sweet (no pun intended).  For the life of me, I do not know why I’m finding this out just now.

Stages of (Middle Class?) Life
1. Learn about yourself 2. Figure out your place in the world 3. Settle into a routine 4. Die a slow and painful death and hope that your kid doesn’t screw it all up like you did

The key take away from Obama’s speech was a call for a new beginning, with a return to those basic, nebulous human virtues of honesty and fairness, to deliver the world in working order to future generations. There have been things in my life that I wish I had done differently. I can use a new beginning.

From Books, New President Found Voice →
There’s something uninspiring when you talk about how person X is a dunce and then you make Y look great by comparing him to X.  The only rational response is to start hating Y, regardless of what you think about X, and to have a more pervasive, general disgust for humanity.

If you want to reach young people (and maybe anybody) you need to be cool and sometimes that requires a redefinition of cool.  What I like about Jay-Z is that he uses his street cred to make certain things cool.  He’s Young HOV, but he’s also Little Orphan Annie.  For all the criticism, from people genuinely trying to make a difference, that it’s still music glorifying selling...

This I Believe: Inviting the World to Dinner →
youngna: Jim Haynes: ” Every week for the past 30 years, I’ve hosted a Sunday dinner in my home in Paris.” “a Dutch political cartoonist, a beautiful painter from Norway, a truck driver from Arizona, a bookseller from Atlanta, a newspaper editor from Sydney, students from all over, and traveling retirees.” = the world

At the end of the day, I think we’re motivated more by the expectations of the people who believe in us than the expectations of those who don’t.  Although, the combination might be the key.

WatchWatch
Probably better to watch the whole thing rather than a montage.  Do you trust Slate?

Jennifer would sit very straight at the table and refuse to look at him, feigning great interest in whatever her parents were saying, though afterwards, waiting for bedtime, she would sometimes go off quietly by herself and suck her thumb. - Revolutionary Road

smalter: I was sorta sad to see that after such a fantastic game—Chargers/Colts—Andrea Kramer asked Philip Rivers and Antonio Gates such stupid questions. I really hoped that Antonio Gates would make some kind of mind-blowing comment about how he fumbled in OT but happened to land on top of the football and rolled over to cover it. She asked him how he got himself ready for the game where he...

Armond White on The Class
Our school system fails due to class and economic issues that Cantet’s racism ignores.Yet critics who ignored the education drama Akeelah and the Bee extol Cantet’s bald white-man’s-burden metaphor. http://nypress.com/article-19181-the-class.html
