Honesty is the Best Policy
The older I get, the more I think trying to game the system is not a good idea. There are a bunch of cases in the law where they say, “well, you keep arguing for A, which we don’t really think is quite right. It looks more like B, but you didn’t really bring up B, so we can’t really do anything about it.” There are certainly valid reasons to want to maintain the integrity of procedural protocol, but I also wonder if it’s sometimes motivated by the judges’ aversion to people trying to slip one past them.
